Section 1: General Provisions
Article 1. Security Service of Ukraine
1) The Security Service of Ukraine is a special-purpose state body with law enforcement functions that ensures the state security of Ukraine.
2) The activities of the service are directed and coordinated by the President, the Prime Minister, and the Minister of Internal Affairs.
Article 2. Tasks of the organization
1) The Security Service of Ukraine is entrusted, within the competence defined by law, with the protection of state sovereignty, constitutional order, territorial integrity, scientific, technical, and defense potential of Ukraine, the legitimate interests of the state, and the rights of citizens from intelligence and subversive activities of foreign special services, encroachments by individual organizations, groups, and individuals, as well as ensuring the protection of state secrets.
2) The tasks of the Security Service of Ukraine also include the prevention, detection, suppression, and disclosure of criminal offenses against the peace and security of mankind, terrorism, and other illegal actions that directly pose a threat to the vital interests of Ukraine.
3) In addition, the tasks of the Security Service of Ukraine include other tasks specified in the organization's charter.
Article 3. Legal basis of the SBU's activities
1) In their activities, employees of the Security Service of Ukraine are guided by current legislation.
Article 4. The concept of an SBU employee
1) An SBU employee is a citizen who has passed an interview for service in an organization, signed a contract and received a special rank.
2) An SBU employee must have a service ID.
Article 5. Special powers regarding interaction with other state bodies
1) The Security Service of Ukraine has the right to initiate and coordinate operational measures with other state bodies, including the Ministry of Health, the State Criminal Executive Committee, the State Emergency Service, the National Police, Ukrzaliznytsia and others, in order to effectively ensure state security.
2) SBU employees are authorized to issue binding proposals, instructions and recommendations to relevant state bodies within their competence related to ensuring state security.
3) Cooperation with other bodies is carried out on the basis of the principles of legality, mutual respect and efficiency.
Section 2: SBU System and Information
Article 6. Legality
1) The Security Service of Ukraine in its activities is guided by the SBU Statute, the Constitution of Ukraine, the Code of Ukraine on Administrative Offenses, the Criminal Code of Ukraine, orders of the Ministry of Internal Affairs and other regulatory legal acts.
2) An SBU employee is prohibited from executing criminal or clearly illegal orders and orders.
3) Orders, instructions and instructions of higher authorities, managers, officials and service personnel, official, political, economic or other expediency cannot be the basis for an employee to violate the legislation.
4) SBU employees may patrol in a unit, patrolling is allowed only from the 3rd rank.
5) SBU employees during orientation may change the procedure for detaining persons at their discretion, as provided for in Article 11 of the Procedural Code of Ukraine.

Article 7. Observance of human rights and freedoms
1) While performing their official duties, an SBU employee shall observe human rights and freedoms guaranteed to him by the current legislation.
2) Restriction of human rights and freedoms is allowed exclusively on the basis of the current legislation.
3) The implementation of measures restricting human rights and freedoms must be immediately terminated if the purpose of applying such measures has been achieved or there is no need for their further application.
4) An SBU employee is prohibited from torturing a person with restricted rights and freedoms and from treating him/her cruelly.
5) During the restriction of a citizen, an SBU employee is obliged to inform him/her of his/her rights and obligations stipulated by law.
6) Every citizen has the right to the assistance of a lawyer, to 1 telephone call, to remain silent, to use the services of an interpreter, and everything said by a citizen may be used against him/her.
Section 3: Powers of the SBU
Article 8. General System of the SBU
1) The organization includes units formed by the Main Directorate of the SBU and approved by the General.
Article 9. Subordination
1) The Security Service of Ukraine is a central executive body that serves society by ensuring the protection of human rights and freedoms, combating crime, maintaining public order and public security.
The SBU is indirectly subordinate to the President of Ukraine, the Prime Minister and the Minister of Internal Affairs.
Article 10. An SBU employee is obliged to
1) Strictly observe the law and act in accordance with the current legislation.
2) Professionally perform his/her official duties in accordance with the requirements approved by law.
3) Respect and not violate human rights and freedoms.
4) Provide emergency first aid to persons injured as a result of any events, as well as persons who find themselves in a helpless state or a state dangerous to their life or health.
5) Have evidence of his/her actions that he/she performs while performing his/her official duties.
6) Inform the management about the circumstances regarding dismissal from service in the organization or removal from a certain position.
7) When addressing a citizen, an SBU employee is obliged to introduce himself in the form, state his position, rank, first and last name, and if the citizen requires it, provide him with his service ID for verification.
Article 11. Responsibility of SBU employees
1) In case of committing illegal acts, SBU employees bear criminal, administrative, civil, material and disciplinary liability in accordance with the law.
2) Types of liability:
- Warning
- Reprimand
- Demotion in rank
- Dismissal from position
- Dismissal from service in the organization
Article 12. Powers of the SBU
1) The Security Service of Ukraine, in accordance with the tasks assigned to it:
- Ensures the protection of state sovereignty, constitutional order and territorial integrity of Ukraine from unlawful encroachments by individuals and their associations.
- Provides assistance to the National Police and other law enforcement agencies in combating the commission of criminal offenses with available forces and means, including technical ones.
- Performs other tasks, on behalf of the President of Ukraine, directly aimed at ensuring the internal and external security of the state.
- Manages state property objects falling under its management in accordance with the procedure established by law.
- Carries out counterintelligence measures to prevent, detect, stop and disclose any forms of intelligence and subversive activities against Ukraine
- Detects, stops and discloses criminal offenses, the investigation of which is attributed by law to the competence of the Security Service of Ukraine, conducts their pre-trial investigation; searches for persons who are hiding in connection with the commission of the specified criminal offenses.
- Ensures the protection of citizens of Ukraine and their property.
- Searches for and detains persons who are wanted.
- Carries out preventive and prophylactic activities aimed at preventing the commission of offenses.
- Takes measures aimed at eliminating threats to the life and health of individuals and public safety that have arisen as a result of the commission of a criminal or administrative offense.
2) In order to fulfill their duties, SBU employees are granted the right to:
- Demand that citizens and officials cease offenses, check in this regard their identity documents, and also conduct an inspection of persons, their belongings and vehicles if there is a threat of a suspect's escape or the destruction or concealment of material evidence of criminal activity.
- Submit to state institutions and organizations of all forms of ownership proposals on national security issues, including ensuring the protection of state secrets, that are mandatory for consideration.
- Receive, upon written request of the head of the relevant body of the Security Service of Ukraine, from state institutions, organizations, citizens and their associations data and information necessary to ensure the state security of Ukraine, as well as use official documentation and reporting for this purpose.
- Enter, in accordance with the procedure agreed with the management or ensuring state security or conducting investigative actions, institutions and organizations and military units, their territory and official premises.
- Draw up protocols and consider cases of offenses and crimes, conduct a personal search, inspection of things, seizure of things and documents, apply other measures provided for by law to ensure the proceedings in cases of administrative or criminal offenses against employees of state institutions and organizations.
- Use, with subsequent reimbursement of expenses and losses, vehicles belonging to state institutions, organizations, citizens for travel to the scene of an incident, stopping criminal offenses, pursuing and detaining persons suspected of committing them, and delivering persons in need of urgent medical care to medical institutions.
- Only in the immediate termination of criminal offenses, investigation, prosecution of persons suspected of committing them, enter residential, office, industrial and other premises, territories and land plots and inspect them.
- Conduct overt and covert operational-search activities.
- Cooperate with citizens of Ukraine and other persons, including on a contractual basis, while observing the conditions of voluntariness and confidentiality of these relations.
- Use on a contractual basis the office premises of institutions, organizations, military units, as well as residential and other premises of citizens.
- Send officials of the Security Service of Ukraine to work in regular positions in other institutions and organizations for the duration of specific tasks in the interests of counterintelligence.
- In the event of a danger to life and health, issue weapons, special means of individual protection and a notification of danger to persons taken under protection.
- Take measures to block bank accounts on the basis of a pre-trial investigation or in case of violations of norms and current legislation, if individuals maliciously evade paying debts.
3) Responsibility for unlawful actions that impede the exercise of the powers of the CBU:
- The lawful requirements of employees of the Security Service of Ukraine when performing their official duties are mandatory for citizens and officials.
- Disobedience or resistance to the lawful requirements of employees of the Security Service of Ukraine, unlawful interference in their lawful activities entail liability as provided for by law.
4) Verification of military registration documents:
- Employees of the Security Service of Ukraine have the right to check the availability of a military registration document (military card or a document replacing it) of citizens of Ukraine within the limits determined by law, to ensure control over compliance with the obligation of military registration and mobilization readiness of the state.
- The check is carried out in order to prevent evasion of military service and other offenses that threaten the national security of Ukraine.
- In case of detection of violations, SBU employees have the right to apply response measures provided for by law.
- The check of military registration documents is carried out during mobilization measures in cooperation with the Armed Forces of Ukraine within the competence of the relevant body.
Section 4: Official measures
Article 13. The concept of official measures
1) An official measure is an action or a set of actions of a preventive or coercive nature that restricts certain human rights and freedoms and is applied by SBU employees in accordance with the law to ensure the exercise of the powers assigned to them.
2) An official measure is used exclusively to fulfill the powers assigned to an SBU employee.
3) The selected official measure must be lawful, necessary, proportionate and effective.
Article 14. Types of official measures
1) The Security Service of Ukraine may apply the following official measures when performing its official duties:
- Checking documents.
- Stopping a vehicle.
- Requirement to leave the place and restriction to a designated territory.
- Application of means of fixation.
- Checking for alcohol and drugs in the blood/body.
- Superficial check.
2) During an official measure, an SBU employee must notify a citizen about the application of a certain official measure in relation to him.
Article 15. Checking documents
1) An SBU employee has the right to demand that a person present documents, namely a passport, if:
- A person violates public order.
- A person is suspected of committing an administrative or criminal offense.
- A person looks like a person who is being targeted or wanted.
- A person is in a special regime territory or facility.
- A person has weapons or ammunition.
- A person is driving a vehicle that is being targeted.
- A person crosses checkpoints / stationary patrol police posts.
- A person is under investigation.
- A person is wearing a mask or other things that do not allow their face to be seen.
- During operational exercises on the instructions of the President or the General of the SBU.
Article 16. Stopping a vehicle
1) An SBU officer has the right to stop a vehicle:
- If the vehicle is being oriented.
- If the vehicle crosses checkpoints.
- If the vehicle has entered a special regime territory.
- If the driver or passenger of the vehicle is wanted.
- If the driver is suspected of committing a criminal or administrative offense.
- An employee of the Security Service of Ukraine has the right to stop vehicles moving without state license plates in order to verify the legality of their stay in the territory of Ukraine, compliance with traffic rules, and the prevention of illegal activities.
- Stopping such vehicles is carried out within the framework of the tasks assigned to the SBU to ensure national security and public order.
- If stroboscopes (of any color) are turned on on the vehicle.
2) It is prohibited to stop for a minor traffic violation.
- It is allowed to stop a driver if he committed a serious traffic violation: a traffic accident, hitting a person, etc.
Article 17. Legal requirements of an SBU employee
1) An SBU employee is authorized to require citizens to leave a certain place for a certain period of time or to prohibit or restrict persons from accessing a certain territory or objects, if this is necessary to ensure public safety and order, protect people's life and health, to preserve and record traces of an offense.
2) An SBU employee may restrict or prohibit the movement of vehicles and pedestrians on certain sections of streets and highways in the event of the detention of persons in accordance with the law, if this is necessary to ensure public safety and order, protect people's life and health.
3) An SBU employee has the legal right to require a citizen to turn off the car engine and leave the vehicle itself for the purpose of checking documents and conducting procedural actions.
4) An SBU employee has the right to issue an order not to leave his vehicle and remain in it, or to issue an order so that other passengers of the vehicle do not leave it during the conduct of procedural actions or the performance of their duties by an SBU employee.
5) An SBU employee, if necessary, has the right to order a citizen not to approach an SBU employee or employees and to maintain a social distance of 5 meters (10 steps) between the citizen and the employee. In case of failure to comply with the order, the employee has the right to detain the citizen for disobedience.
Article 18. Use of recording devices
1) The Security Service of Ukraine, in order to perform its tasks and exercise its powers defined by law, may use technical devices for photo, video and audio recording in order to detect and record administrative, criminal and other offenses.
2) Recorded evidence must be kept for 7 days.
Article 19. Testing for alcohol and drugs in the blood/body
1) An SBU officer may test a citizen for the presence of alcohol or drugs in the blood or body if:
- The citizen is suspected of committing an offense under the influence of these substances.
- The citizen's behavior does not correspond to the normal situation.
- During a pre-trial investigation.
2) An SBU officer may test a citizen for the presence of alcohol or drugs in the blood/body using a Drug Tester/Breath Tester.
3) In case of refusal to undergo a medical examination for intoxication using a Drug Tester/Breath Tester, the examination is conducted by an employee of the Ministry of Health.
4) If a citizen completely refuses to undergo a medical examination for intoxication both with the help of Testers and with the participation of a Doctor, then the citizen is liable for the specified offense. Refusal is equated with the specified offense.
Article 20. Surface check
1) An SBU officer may conduct a surface check of a person or vehicle if:
- There are sufficient grounds to believe that an offender or a person whose freedom is being illegally restricted is in the vehicle.
- There are sufficient grounds to believe that an item is in the vehicle, the circulation of which is prohibited or restricted or which poses a threat to the life or health of such a person or other persons.
- There are sufficient grounds to believe that the item or vehicle is an instrument of an offense and/or is in a place where a criminal offense may be committed, to prevent which it is necessary to conduct a surface check.
- The person/vehicle is on a state wanted list or orientation.
- A citizen has filed a complaint that there are illegal items in the person/vehicle.
- The person is wearing a mask or other items that do not allow their face to be seen.
2) Conducting a search and seizure of illegal items is permitted in the following cases:
- In the case of selling goods without an appropriate license.
- In the case of violations of order by a citizen using weapons/narcotics/excisable goods.
- If a citizen is in a public place with a weapon without an appropriate permit, except for a smooth-bore hunting weapon.
- If, according to operational information, it was established that the person is intoxicated with alcohol or drugs.
- If the person is suspected of committing a criminal or administrative offense.
- If the citizen is in orientation.
3) An SBU employee is prohibited from conducting a search of a detainee without proper grounds.
4) Evidence of a search must be kept for up to 7 days.
Article 21. Coercive measures
1) SBU employees, when exercising their powers, are authorized to use the following coercive measures:
- Physical force
- Use of special means
- Use of firearms
Article 22. Physical force
1) An SBU employee may use physical force, including special hand-to-hand combat techniques, to ensure personal safety or the safety of other persons, stop an offense, and detain a person who has committed an offense.
2) Breaking an offender for the purpose of further handcuffing a citizen is a measure of physical force.
Article 23. Use of special means
1) An SBU employee is authorized to use special means against a citizen in the event that he commits an administrative or criminal offense.
2) Types of special means:
- Contact-remote device "Taser".
- Means of mobility restriction "Handcuffs".
- Optical-electronic means of a thermal imaging or night vision device.
Article 24. Use of firearms
1) An SBU employee is authorized to use firearms:
- To repel an attack on an employee or other citizens.
- To release hostages or persons illegally deprived of their liberty.
- To repel an attack on objects under guard.
- To detain a person who was caught committing an offense and who is trying to escape.
- To stop a vehicle by damaging it.
- An SBU employee may use firearms in the air to call for auxiliary forces.
2) It is allowed to use firearms on a vehicle only outside the boundaries of a settlement, or in places where such actions will not cause danger to other citizens, except in cases of such necessity.
3) An SBU employee may take possession of a firearm and bring it into combat readiness if the situation in question provides grounds for its use.
Section 5: Service in the organization
Article 25. Service in the organization
1) Service in the SBU organization is a state service of a special nature, which is a professional activity of employees to fulfill the powers assigned to SBU employees.
Article 26. Contract terms
1) Upon joining the Security Service of Ukraine, each employee is obliged to work 3 days under the contract.
2) After receiving the next special rank, each employee is obliged to work 3 days from the moment of his promotion.
3) In case of violation of the terms of contract service, an SBU employee may be dismissed for violation of the statute.
4) The dismissal report is considered as soon as possible.

- The check is carried out in order to prevent evasion of military service and other offenses that threaten the national security of Ukraine.
- In case of detection of violations, SBU employees have the right to apply response measures provided for by law.
- The check of military registration documents is carried out during mobilization measures in cooperation with the Armed Forces of Ukraine within the competence of the relevant body.
Section 4: Official measures
Article 13. The concept of official measures
1) An official measure is an action or a set of actions of a preventive or coercive nature that restricts certain human rights and freedoms and is applied by SBU employees in accordance with the law to ensure the exercise of the powers assigned to them.
2) An official measure is used exclusively to fulfill the powers assigned to an SBU employee.
3) The selected official measure must be lawful, necessary, proportionate and effective.
Article 14. Types of official measures
1) The Security Service of Ukraine may apply the following official measures when performing its official duties:
- Checking documents.
- Stopping a vehicle.
- Requirement to leave the place and restriction to a designated territory.
- Application of means of fixation.
- Checking for alcohol and drugs in the blood/body.
- Superficial check.
2) During an official measure, an SBU employee must notify a citizen about the application of a certain official measure in relation to him.
Article 15. Checking documents
1) An SBU employee has the right to demand that a person present documents, namely a passport, if:
- A person violates public order.
- A person is suspected of committing an administrative or criminal offense.
- A person looks like a person who is being targeted or wanted.
- A person is in a special regime territory or facility.
- A person has weapons or ammunition.
- A person is driving a vehicle that is being targeted.
- A person crosses checkpoints / stationary patrol police posts.
- A person is under investigation.
- A person is wearing a mask or other things that do not allow their face to be seen.
- During operational exercises on the instructions of the President or the General of the SBU.
Article 16. Stopping a vehicle
1) An SBU officer has the right to stop a vehicle:
- If the vehicle is being oriented.
- If the vehicle crosses checkpoints.
- If the vehicle has entered a special regime territory.
- If the driver or passenger of the vehicle is wanted.
- If the driver is suspected of committing a criminal or administrative offense.
- An employee of the Security Service of Ukraine has the right to stop vehicles moving without state license plates in order to verify the legality of their stay in the territory of Ukraine, compliance with traffic rules, and the prevention of illegal activities.
- Stopping such vehicles is carried out within the framework of the tasks assigned to the SBU to ensure national security and public order.
- If stroboscopes (of any color) are turned on on the vehicle.
2) It is prohibited to stop for a minor traffic violation.
- It is allowed to stop a driver if he committed a serious traffic violation: a traffic accident, hitting a person, etc.
Article 17. Legal requirements of an SBU employee
1) An SBU employee is authorized to require citizens to leave a certain place for a certain period of time or to prohibit or restrict persons from accessing a certain territory or objects, if this is necessary to ensure public safety and order, protect people's life and health, to preserve and record traces of an offense.
2) An SBU employee may restrict or prohibit the movement of vehicles and pedestrians on certain sections of streets and highways in the event of the detention of persons in accordance with the law, if this is necessary to ensure public safety and order, protect people's life and health.
3) An SBU employee has the legal right to require a citizen to turn off the car engine and leave the vehicle itself for the purpose of checking documents and conducting procedural actions.
4) An SBU employee has the right to issue an order not to leave his vehicle and remain in it, or to issue an order so that other passengers of the vehicle do not leave it during the conduct of procedural actions or the performance of their duties by an SBU employee.
5) An SBU employee, if necessary, has the right to order a citizen not to approach an SBU employee or employees and to maintain a social distance of 5 meters (10 steps) between the citizen and the employee. In case of failure to comply with the order, the employee has the right to detain the citizen for disobedience.
Article 18. Use of recording devices
1) The Security Service of Ukraine, in order to perform its tasks and exercise its powers defined by law, may use technical devices for photo, video and audio recording in order to detect and record administrative, criminal and other offenses.
2) Recorded evidence must be kept for 7 days.
Article 19. Testing for alcohol and drugs in the blood/body
1) An SBU officer may test a citizen for the presence of alcohol or drugs in the blood or body if:
- The citizen is suspected of committing an offense under the influence of these substances.
- The citizen's behavior does not correspond to the normal situation.
- During a pre-trial investigation.
2) An SBU officer may test a citizen for the presence of alcohol or drugs in the blood/body using a Drug Tester/Breath Tester.
3) In case of refusal to undergo a medical examination for intoxication using a Drug Tester/Breath Tester, the examination is conducted by an employee of the Ministry of Health.
4) If a citizen completely refuses to undergo a medical examination for intoxication both with the help of Testers and with the participation of a Doctor, then the citizen is liable for the specified offense. Refusal is equated with the specified offense.
Article 20. Surface check
1) An SBU officer may conduct a surface check of a person or vehicle if:
- There are sufficient grounds to believe that an offender or a person whose freedom is being illegally restricted is in the vehicle.
- There are sufficient grounds to believe that an item is in the vehicle, the circulation of which is prohibited or restricted or which poses a threat to the life or health of such a person or other persons.
- There are sufficient grounds to believe that the item or vehicle is an instrument of an offense and/or is in a place where a criminal offense may be committed, to prevent which it is necessary to conduct a surface check.
- The person/vehicle is on a state wanted list or orientation.
- A citizen has filed a complaint that there are illegal items in the person/vehicle.
- The person is wearing a mask or other items that do not allow their face to be seen.
2) Conducting a search and seizure of illegal items is permitted in the following cases:
- In the case of selling goods without an appropriate license.
- In the case of violations of order by a citizen using weapons/narcotics/excisable goods.
- If a citizen is in a public place with a weapon without an appropriate permit, except for a smooth-bore hunting weapon.
- If, according to operational information, it was established that the person is intoxicated with alcohol or drugs.
- If the person is suspected of committing a criminal or administrative offense.
- If the citizen is in orientation.
3) An SBU employee is prohibited from conducting a search of a detainee without proper grounds.
4) Evidence of a search must be kept for up to 7 days.
Article 21. Coercive measures
1) SBU employees, when exercising their powers, are authorized to use the following coercive measures:
- Physical force
- Use of special means
- Use of firearms
Article 22. Physical force
1) An SBU employee may use physical force, including special hand-to-hand combat techniques, to ensure personal safety or the safety of other persons, stop an offense, and detain a person who has committed an offense.
2) Breaking an offender for the purpose of further handcuffing a citizen is a measure of physical force.
Article 23. Use of special means
1) An SBU employee is authorized to use special means against a citizen in the event that he commits an administrative or criminal offense.
2) Types of special means:
- Contact-remote device "Taser".
- Means of mobility restriction "Handcuffs".
- Optical-electronic means of a thermal imaging or night vision device.
Article 24. Use of firearms
1) An SBU employee is authorized to use firearms:
- To repel an attack on an employee or other citizens.
- To release hostages or persons illegally deprived of their liberty.
- To repel an attack on objects under guard.
- To detain a person who was caught committing an offense and who is trying to escape.
- To stop a vehicle by damaging it.
- An SBU employee may use firearms in the air to call for auxiliary forces.
2) It is allowed to use firearms on a vehicle only outside the boundaries of a settlement, or in places where such actions will not cause danger to other citizens, except in cases of such necessity.
3) An SBU employee may take possession of a firearm and bring it into combat readiness if the situation in question provides grounds for its use.
Section 5: Service in the organization
Article 25. Service in the organization
1) Service in the SBU organization is a state service of a special nature, which is a professional activity of employees to fulfill the powers assigned to SBU employees.
Article 26. Contract terms
1) Upon joining the Security Service of Ukraine, each employee is obliged to work 3 days under the contract.
2) After receiving the next special rank, each employee is obliged to work 3 days from the moment of his promotion.
3) In case of violation of the terms of contract service, an SBU employee may be dismissed for violation of the statute.
4) The dismissal report is considered as soon as possible.
